The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 395 of the Indian Penal Code.
FIR named and some unknown thieves, allegedly, committed dacoity in the house of the informant. During investigation, voter identity card of the petitioner and his brother was found near the place of occurrence. Hence, the petitioner and his brother were also implicated. Thereafter in the confessional statement, brother of the petitioner named this petitioner also. The aforesaid is sufficient to not to grant anticipatory bail to the petitioner in connection with Shyampur Bhatha Police Station Case No. 81 of 2016 pending in the court of learned
Patna High Court Cr.Misc. No.19963 of 2017 (3) dt.03-07-2017 2/2 Judicial Magistrate, 1st Class, Sheohar.
Hence, prayer for bail is refused.
In the event of surrender and prayer for regular bail, the court below shall consider the prayer for bail without being prejudiced by this order and also considering the material brought on the record to substantiate that the petitioner had handed over his voter identity card to the named persons for getting electric supply connection.
With the aforesaid observation, this application stands disposed of.
