JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-02-2016 Heard learned counsels for the petitioner and the State. The petitioner being the brother of the husband of informant is apprehending arrest in a case registered for the offences punishable under Sections 341, 323 and 498A/34 of the Indian Penal Code.
It is alleged that the petitioner caused head injury to the cousin brother of the informant.
It is submitted by learned counsel for the petitioner that none had received any injury. A statement to that effect has been made in paragraph 10 of the petition which reads as such :- "10. That in fact non had received any injury by making assault of the petitioner ...".
The impugned order reflects that though case diary was transmitted by the investigating agency but without injury report
Patna High Court Cr.Misc. No.5332 of 2016 (2) dt.02-02-2016 2/2 which reflects the casual manner in which the investigating agency is proceeding in the matter.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Patna in connection with Kankarbagh P.S. Case No.713/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U t
