JUSTICE BIRENDRA KUMAR ORAL ORDER 03-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is apprehending her arrest in a case registered for the offence punishable under Section 302 of the Indian Penal Code.
Allegation against the petitioner and her son is that they took Vimal Kumar Yadav with them and subsequently Vimal Kumar Yadav died of electrocution. The eye-witnesses examined before the police have stated that Vimal touched the live electric wire while he was mending the same.
Submission of the learned counsel for the petitioner is that this may be a case of negligence and not a case of committing culpable homicide.
Learned counsel for the informant opposed the prayer
Patna High Court Cr.Misc. No.20018 of 2017 (3) dt.03-07-2017 2/2 for bail on the ground that the petitioner and others had forcefully taken the victim knowing the fact that he is not an electric mechanic.
Considering the fact that this is a case of negligence, let the petitioner, above named, who is a female, in the event of her arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Jamui/successor Court in connection with Jhajha Police Station Case No. 201 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
