This is a petition for grant of anticipatory bail for offence under Sections 341, 323, 324, 307 and 34 of the Indian Penal Code.

Allegation against the petitioner is that for land dispute he committed assault with dabia, causing injury on the head of the informant. The injury report reveals that the doctor had found head injury on the person of the informant. The learned counsel for the petitioner submits that false implication is there due to land dispute and there is delay in lodging of the first information report.

Initially the injured had gone to Nalanda Medical College and Hospital, Patna. However, no prescription or injury report of Nalanda Medical College and Hospital, Patna, is there. Considering the fact that the petitioner had knowledge that his act might cause death, I am not inclined to grant anticipatory bail to the petitioner.

The prayer for anticipatory bail is refused.
