2. The petitioner has prayed for regular bail in a case instituted for the offence under Section 392 of the Indian Penal Code.

3 As per FIR, while the informant was returning carrying Rs. 8,85,000/- in cash having collected the money from market, it is stated that three accused persons on a motorcycle tried to stop him and on his not stopping they dashed their motorcycle against his vehicle. They took away his motorcycle as also the amount that he was carrying.

4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. The

Patna High Court CR. MISC. No.65505 of 2023(2) dt.13-10-2023 2/2 name of the petitioner has come on the basis of confessional statement of co-accused, Sonu Kumar, who is enlarged on bail vide order dated 18.05.2023 passed in Cr. Misc. No.24315 of 2023. Petitioner is in custody since 20.07.2023.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to Additional the satisfaction of the learned Judicial Magistrate- 1st Class, Raxaul, Motihari, East Champaran, in connection with Chhauradano P.S. Case No. 304 of 2022.
