2. The petitioner is in custody in connection with Baniyapur P.S. Case No. 300 of 2022 for the offence under Sections 341, 323, 302, 34 of the Indian Penal Code.

3. As per prosecution, the petitioner is said to have caught hold of the deceased and one accused, namely, Jitendra Singh having Barchi in his hand pierced the left side of the chest of the informant's brother with an intention to kill him and due to which he sustained injury and thereafter, he was taken to hospital. The brother of the informant died during course of treatment.

4. Learned counsel for the petitioner submits that the petitioner is in custody since 15.06.2022 and he has falsely been implicated in this case.

Considering the fact that petitioner is not the assailant of the deceased and also considering the period of custody, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-IV, Saran at Chapra in connection with Baniyapur P.S. Case No. 300 of 2022. (Sandeep Kumar, J) Harsh/ U T
