1. Heard learned counsel for the petitioners and learned APP for the State.
2. The petitioners have prayed for bail in a case registered for the offence punishable under Sections 341, 323, 307, 302, 504/34 of the Indian Penal Code and Section 27 of the Arms Act.
3. The allegation against the petitioners along with others is of firing upon the husband of the informant leading to his death. It is further alleged that the accused persons also brutally assaulted the Bhaisur of the informant, due to which he sustained injury.
4. It is submitted by learned counsel for the petitioners
Patna High Court CR. MISC. No.65102 of 2023(2) dt.12-10-2023 2/2 that petitioners have been falsely implicated in this case due to land dispute. There is no specific overt act of firing against these petitioners. Petitioners are ladies and there is only general and omnibus allegation levelled against them and they are a member of unlawful assembly. Petitioners have got no criminal antecedent and languishing in judicial custody since 21.07.2023.
5. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, being ladies as well as period of custody, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., East Champaran, Motihari in connection with Harsidhi P.S. Case No. 464 of 2023.
