The appellants have been convicted under Sections 341, 323 and 324 of the Indian Penal Code but instead of sentencing them have been given the benefit under Section 3⁄4 of the Probation of Offenders Act and have been released on executing bond of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each and in that view the appeal is not maintainable under Section 376(b) of the Code of Criminal Procedure and the same is dismissed.
