JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 10-01-2022 Heard the learned counsel for the petitioner through video conferencing. None appeared on behalf of the complainant despite the fact that the notice has personally been served on the complainant, Jarina Khatoon.

The petitioner apprehends his arrest in connection with Complaint Case bearing C.R. No. 679 of 2017 (CIS)/679 of 2017 (CR) registered for offence punishable under sections 323, 341, 498(A) and 379 of the Indian Penal Code and section 3/4 of the Dowry Prohibition Act.

As per complaint petition, the marriage of the complainant was solemnized with the petitioner in the year 2011

Patna High Court CR. MISC. No.58740 of 2019(9) dt.10-01-2022 2/2 and one son and one daughter were born out of the wedlock of the couple. Thereafter, the accused persons started demanding dowry. The allegation against the petitioner is that he, in drunken condition, used to assault the complainant. To explore the possibility of the amicable solution, notice was issued to the complainant, which was received by her father. Later on, again notice was sent, which was personally received by the complainant, but she did not turn for mediation process.

Considering the above mentioned facts and circumstances, the petitioner above named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Madhubani in connection with Complaint Case bearing C.R. No. 679 of 2017 (CIS)/679 of 2017 (CR), subject to condition as laid down under section 438(2) Cr. P.C.
