The wife being the complainant alleged that she is being tortured by the husband/petitioner. Like the stand taken before the learned sessions judge, the petitioner has taken the similar stand here also that he is ready and willing to keep his wife with all safety and dignity. Given a chance both of them would resolve the dispute. Both parties have shown inclination for resolution of the dispute with the help of mediator. Counsel for the complainant has taken a stand that complainant will appear before the Court below and cooperate in the mediation proceeding.

Patna High Court Cr.Misc. No.51865 of 2014 (4) dt.26-05-2015 2/2 Considering the aforesaid stand, this Court directs the petitioner, named above, to surrender before the learned Court below within a period of three weeks and make a prayer for resolution of the issue through mediation between the parties . In case he surrenders with the aforesaid prayer learned Court below in seisin of the matter shall provisionally release the petitioner on bail for a period of 08 weeks therefrom on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Jahanabad in connection with Complaint case no. 134 of 2014 Tr. No. 3578 of 2014, subject to the condition as laid down under Section 438 (2) of the Cr. P.C.

with further condition that one of the bailors shall be the own/close family members of the petitioner. The matter shall thereafter be immediately referred to the mediation centre for resolution of the dispute. Upon receipt of the report of the mediation proceeding, the learned Court below shall either confirm or reject the provisional bail of the petitioner.
