2. The petitioner apprehends his arrest in connection with Amas P.S. Case No. 215 of 2025, registered for the offences punishable under Sections 317(5), 318(4), 336(3), 338, 3(5) of BNS, 2023.

3. Rakesh Kumar, ASI, lodged his self written report stating therein that he apprehended Anis Kumar with a motorcycle which was stolen one. Anis Kumar apprised the informant that he purchased the said motorcycle from the petitioner.

4. The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.63051 of 2025(3) dt.01-11-2025 2/2 that the petitioner is innocent and has falsely been implicated. Nothing was recovered from his possession. His name has figured on the confessional statement of co-accused. He is a person of clean antecedent.

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Gaya in connection with Amas P.S. Case No. 215 of 2025, subject to the conditions as laid down under Section 438(2) Cr.P.C.

7. After accepting the bail bonds, the learned court below shall verify the criminal antecedent of the petitioner and if it is found that he is involved in any other case except the present one, his bail bonds shall be cancelled. (Nawneet Kumar Pandey, J) kundan/- U T
