JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 354 and 376/511/34 of the Indian Penal Code.

It is alleged that the petitioner used to tease the informant and on 10.08.2014 at 11.30 AM, the petitioner entered into the house of the informant, put his hand on the back of the informant and tried to outrage the modesty. In the meantime, the husband of the informant came then the petitioner assaulted on his head with iron rod.

It is submitted by learned counsel for the petitioner that for the occurrence of 10.08.2014, the fardbeyan was recorded on the same day but it was registered on 14.08.2014. Though, two days prior to the occurrence, the mother of the petitioner filed a

Patna High Court Cr.Misc. No.1756 of 2015 (2) dt.15-01-2015 2/2 written report against the informant for opening of a window toward courtyard and bathroom of the petitioner's house. Moreover, in fact no injury has been received by the informant. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

Considering the enmity between the parties from before, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Patna in connection with Patrakar Nagar P.S. Case No. 184 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
