KUMAR ORAL ORDER 13-07-2017 Heard learned counsel for the petitioner and the State. Petitioner is apprehending his arrest in Birpur P.S. Case no. 60 of 2016 for the offences registered under Sections 147, 148, 149, 323, 324, 341, 504 and 307 of the Indian Penal Code. Later on, Section 302 of the IPC has been added. Allegation against the petitioner is that he was order giver in the assault made by other accused. He is named in the FIR. Injuries are sustained by informant and his family members. It has been submitted by the learned counsel for the petitioner that there is case and counter case between the parties. Petitioner is about 75 years. There is no allegation of assault made against him. Similarly situated co-accused persons have been granted anticipatory bail by a Bench of this Court vide Annexure2 to this petition.
Patna High Court Cr.Misc. No.32019 of 2017 (2) dt.13-07-2017 2/2 Considering the facts and circumstances of the present case, let petitioner, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Birpur (Supaul), in Birpur P.S. Case no. 60 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
