====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 04-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is apprehending his arrest in connection with Bhorey P.S. Case No. 224/16 for the offences punishable under Sections 420, 467 and 468 of the Indian Penal Code. The informant Yogendra Sharma, lodged Kota Rail P.S. Case No. 2558 of 2016 under Sections 137 and 42 of the Railway Act against the petitioner. In that case petitioner was granted bail by the learned A.D.J.-II, Kota vide Annexure-2. The same FIR was forwarded to the State of Bihar and present Bhorey P.S. Case No. 224 of 2016 has been registered. Considering the fact that the petitioner is already on bail in this case, hence there is no reason that in the event of
Patna High Court Cr.Misc. No.20847 of 2017 (3) dt.04-07-2017 2/2 appearance of the petitioner before the court below, the petitioner would be taken into custody. This anticipatory bail is not maintainable in the same very case.
Accordingly petition stands disposed of.
