The petitioners seek bail in connection with Maniyari P. S. Case No.379 of 2021, instituted for the offences under Section 30(a) of the Excise Act, 2016.

The learned counsel for the petitioners submits that the petitioners are in custody since 08.11.2021, they are persons with clean antecedent, charge-sheet has been submitted in the case and petitioner no.2 is a female.

Allegation is of recovery of 22 litre of liquor from the hut of the petitioner.

The learned counsel for the petitioners submits that

Patna High Court CR. MISC. No.72009 of 2021(2) dt.02-03-2022 2/2 petitioners have been falsely implicated in the case. Nothing was recovered from the hut, nor the hut belongs to the petitioners.

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioners are in custody, they are persons with clean antecedent, charge-sheet has been submitted in the case and petitioner no.2 is a female, the petitioners, above-named, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 500/- (Rupees Five hundred) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Muzaffarpur in connection with Maniyari P. S. Case No.379 of 2021. The application stands allowed.
