1. Learned counsel appearing on behalf of the petitioner has now retired on attaining age of superannuation but on account of stagnation he has to suffer adverse financial consequences. He submits that petitioner may be granted liberty to file representation before the University so that University may consider the case of the petitioner for grant of Time Bound Promotion/ ACP.

2. Without expressing any opinion on the claim of

Patna High Court CWJC No.22391 of 2012(5) dt.13-09-2018 2/2 the petitioner, the writ petition is disposed of with liberty to the petitioner to file representation before the University. In case such representation is filed by the petitioner, the University may consider the case of the petitioner in accordance with appropriate rule applicable at the relevant time and consider the case of the petitioner for grant of Time Bound Promotion/ACP, If the petitioner is found otherwise eligible. Final decision in this regard may be taken by the University within a period of four months from the date of filing of the said representation.

3. With the aforesaid, the writ petition stands disposed of.
