JUSTICE BIRENDRA KUMAR ORAL ORDER 04-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in connection with Pipra P.S. Case No. 11/2015 for the offences punishable under Section 461/379 of the Indian Penal Code. Some unknown person stolen away the truck of the informant. The said truck was recovered from the possession of the brother of petitioner Dinesh Tiwary and another petitioner is father of Dinesh Tiwary.

Petitioners have stated that they have got no such criminal antecedent though they are accused in Madhuban P.S. Case No. 326/15 under Sections 414, 420, 465, 466, 468, 471,

Patna High Court Cr.Misc. No.21757 of 2017 (4) dt.04-07-2017 2/2 474/34 I.P.C.

Considering the fact that there is no substantial material against the petitioner.

Let, the petitioner, above named, in the event of his arrest or surrender the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned concerned Court below/Successor Court in connection with Pipra P.S Case No. 11/2015 subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. With further condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
