ANJANA MISHRA ORAL ORDER 28-07-2017 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Aurangabad Town P.S. Case No.107 of 2017 for allegedly having committed the offences under Sections 379, 411 and 120B of the Indian Penal Code.
Learned counsel for the petitioners submits that though at the time when the vehicle was intercepted, the Driver of the truck offered all relevant documents, but the same were not taken notice of and an F.I.R. was registered against the present petitioners. It is further submitted that later on, the Investigating Officer had found that all relevant documents
Patna High Court Cr.Misc. No.32015 of 2017 (2) dt.28-07-2017 2/2 were, in fact, genuine and the same were forwarded to the Mines Department, so the allegation against the petitioners have been found to be untrue.
In view of the aforementioned facts and circumstances and that these petitioners have no criminal antecedents, let both the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of `10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad, in connection with Aurangabad Town P.S. Case No.107 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) PNM U T
