Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 341, 323, 324, 504,307/34 of the Indian Penal Code.

Prosecution's case in short is that all the FIR named 10 accused persons including these petitioners brutally assaulted the informant side by means of lathi, danda, etc.as a result of which five persons sustained injuries.

Learned counsel appearing for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case due to village politics. There is general and omnibus allegation of assault against the accused persons

Patna High Court CR. MISC. No.66134 of 2022(2) dt.17-03-2023 2/2 and no specific overt act has been alleged against these petitioners. Petitioners have got no criminal antecedent. Considering the nature of dispute against the petitioners, in the event of arrest/surrender within six weeks from today, let the petitioners, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan in Bhagwanpur Hat Police Station Case No. 300/2020, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
