ANJANA MISHRA ORAL ORDER 01-10-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing for the State. Since both these applications arise out of one and the same P.S. Case, they have been heard together and are being disposed of by this common order.

Petitioners being named accused persons apprehend their arrest in connection with Triveniganj P.S. Case No. 134 of 2014 registered for the offences punishable under sections 420, 372/34 of the Indian Penal Code and section 3⁄4 of

Patna High Court Cr.Misc. No.21507 of 2015 (2) dt.01-10-2015 the Immoral Traffic Act, 1956.

Learned counsel for the petitioners submits that though allegation has been made against the petitioner of having taken away the victim lady, there is no plausible explanation offered by her for the delay in filing the case. It is further submitted on behalf of the petitioners that though the victim lady had escaped from Delhi on 07.07.2014, yet the present case was lodged on 19.07.2014 for the reasons best known to her. He further submits that other similarly situated accused persons have been extended the privilege of bail in Criminal Misc. Nos.12278 of 2015 and 19085 of 2015 vide order dated 27.05.2015.

Considering the aforementioned facts and circumstances of the case and that the petitioners have got no criminal antecedent, petitioners above named, in the event of arrest or surrender in the court below within three weeks from the date of receipt/production of a copy of this order, shall be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri S. Ram, learned Judicial Magistrate, Supaul in connection with Triveniganj P.S. Case no. 134 of 2014 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure, 1973.
