JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-01-2015 The victim girl appears in person before this court and states that she has solemnized her marriage with the petitioner by her own sweet will and presently, she is residing with the petitioner.

Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Marauna P.S. Case No. 19 of 2013 registered for the offence punishable under Section 366A/34 of the Indian Penal Code. The accusation against the petitioner is that he abducted the victim who was minor at the time of alleged occurrence but taking note of above stated statement of victim, I think it proper to extend the privilege of anticipatory bail to petitioner. Accordingly, this anticipatory bail petition is allowed

Patna High Court Cr.Misc. No.52150 of 2014 (3) dt.13-01-2015 and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Supaul in Marauna P.S. Case No. 19 of 2013 subject to condition as laid down under Section 438(2) of the Cr.P.C.
