ANJANA MISHRA ORAL ORDER 19-11-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 12.06.2019 in connection with Laukahi P.S. Case No.108/2019 corresponding to G.R. No.1059 of 2019 registered for the offence under Sections 272, 273/34 of the I.P.C. and Sections 30(a), 41(1) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the entire allegation is false and mischievous and no recoveries were made from his conscious possession. It is only because the petitioner did not respond to the illegal demand of money by the police, that he has been implicated in connection with the present case.

No.71328 of 2019(3) dt.19-11-2019 2/2 Considering the aforementioned facts and circumstances and that the alleged recoveries were not from his conscious possession and also that the petitioner is not having any criminal antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the court of learned 2nd Additional Sessions Judge-Cum-Special Judge, Excise Act, Madhubani, in connection with Laukahi P.S. Case No.108/2019 corresponding to G.R. No.1059 of 2019.
