Apprehending his arrest in connection with Nautan P.S.Case No. 108 of 2016 registered for the offences under Sections 272 and 273/34 of the Indian Penal Code and Section 47 of the Bihar Prohibition and Excise Act, 2016, the petitioner has filed the present application under Section 438 of the Code of Criminal Procedure for grant of pre-arrest bail. Regard being had to the recovery of huge quantity of country made liquor from the Scorpio vehicle of the petitioner, I am not inclined to grant pre-arrest bail to the petitioner. Accordingly, the prayer for grant of pre-arrest bail is rejected.

In case the petitioner surrenders and seeks bail, the same

Patna High Court Cr.Misc. No.31042 of 2017 (2) dt.13-07-2017 2/2 shall be considered on its own merit without being prejudiced in any manner by this order.
