The petitioner has filed the present writ application for a direction to the respondents to absorb him on the post of ClassIV employee, as he has continuously worked for 240 days. Learned counsel for the petitioner submits that the petitioner has worked for a considerably long time in the University. He refers to the order passed by this Court dated 29.04.2009 in

Patna High Court CWJC No.22072 of 2012 dt.05-07-2018 2/2 C.W.J.C. No. 5459 of 2009 and order dated 16.05.2012 passed in C.W.J.C. No. 12743 of 2011 to contend that the case of the petitioner is similar and as such the writ application may be disposed of in the similar terms.

Accordingly, the writ application is disposed of. However, it is made clear that this Court has not expressed any opinion on the claim of the petitioner and it is up to the University to decide the claim of the petitioner in accordance with law laid down by the Apex Court in the case of Secretary, State of Karnataka and Ors. Vs. Umadevi and Others, reported in (2006) 4 SCC 1 and further clarified in the case of State of Karnataka & Others Vs. M. L. Kesari & Ors., reported in (2010) 9 SCC 247, if not already decided, within a period of six months from the date of receipt/production of a copy of this order.
