The petitioners apprehend their arrest in Lalganj P.S. Case No. 134 of 2014, registered for the offences punishable under Section 420 and other Sections of the Indian Penal Code. Manju Devi in sum and substance made allegation that Navin Kumar Singh and others took her husband and got a sale deed executed while her husband was in inebriated condition. Learned counsel for the petitioners submits that the petitioners are only witnesses to the sale deed. Lalan Jha the husband of the informant voluntarily executed the sale deed after appearing before sub-registrar. Uncle of Lalan Jha filed a Title Suit No. 326 of 2014 for setting aside the sale deed executed by Lalan Jha.

No.347 of 2015 (2) dt.08-01-2015 Having considered the facts aforesaid and the fact that a suit has already been filed by the uncle of executant of the sale deed for setting aside the sale deed and the petitioners are witnesses to the sale deed, the petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Lalganj P.S. Case No. 134 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
