The petitioner is apprehending arrest in a case registered for the offences punishable under Section 366A/34 of the Indian Penal Code.
Accusation is of kidnapping the minor daughter of the informant. In 164 Cr.P.C, statement the victim has stated that the petitioner handed over the victim to the co-accused Bijay after taking consideration amount of Rs.35,000/-, from where she has been recovered.
Considering the nature of accusation, this Court is not inclined to grant anticipatory bail to the petitioner. Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a
Patna High Court Cr.Misc. No.21276 of 2015 (2) dt.20-05-2015 2/2 period of six weeks in connection with Harsidhi P.S. Case No.347 of 2014, pending before the learned Chief Judicial Magistrate, East Champaran, Motihari.
