Petitioner is accused in connection with Special Case No. 10327 of 2018, arising out of Shahpur P.S. Case No. 326 of 2018 registered under Section 30 (a) and 37 (c) of the Bihar Prohibition and Excise Act, 2016.

It is alleged in the written report that total 20 liter of Mahua liquor was recovered from possession of this petitioner. Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case. It is further submitted that petitioner is languishing in custody since 29.10.2018 having one criminal antecedent of similar nature in which he is on bail.
