Petitioner, who is in custody, seeks bail in connection with Sonepur (Hajipur) Rail P.S. Case No. 96 of 2018 registered for the offences punishable under Sections 8/20(B)(II)(C), 22, 29 of the N.D.P.S. Act.

Informant who is a police officer has stated in his written complaint that on receiving secret information that three miscreants are waiting to take a train with contraband substance and thereafter he reached the platform and found three persons sitting near the over bridge and from possession of petitioner 12 Kgs. of Ganja was recovered which was kept in a bag.

Patna High Court Cr.Misc. No.79318 of 2018(3) dt.19-02-2019 2/3 It has been submitted on behalf of the petitioner that he has been falsely implicated in this case and he is having no criminal antecedent. Petitioner is in custody since 04.08.2018.

Considering the nature of allegation and recovery of 12 Kgs. Of Ganja, I am not inclined to grant bail to the petitioner. Accordingly the prayer for bail is rejected at this stage.

However, petitioner may renew his prayer for bail in court below after completion of one year in judicial custody and shall be released on bail after one year of custody on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Incharge Sessions Judge, Vaishali at Hajipur, in connection with Sonepur (Hajipur) Rail P.S. Case No. 96 of 2018, with conditions:

(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be represented on each and every date fixed by the court.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.

(4) If the petitioner is found involved in similar nature of offences, after his release on bail the

With the aforesaid liberty this criminal miscellaneous stands disposed of.
