2. The petitioner has prayed for regular bail in a case instituted for the offence under Sections 406, 419, 420, 467, 468/34 of the Indian Penal Code.
3. As per prosecution case, the informant is the Branch Manager, Jahagir Branch, UBI has filed written application before SHO Gangaur P.S. alleging therein that he has filed a list of altogether 65 beneficiaries who have got loan from the Bank by showing their wrong LPC ( Land Possession
Patna High Court CR. MISC. No.63981 of 2023(2) dt.11-10-2023 2/3 Certificate) and requested to lodge the FIR against these beneficiaries for committing cheating with Bank.
4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He has committed no offence. He submitted that the petitioner has never taken any K.C.C. loan from Union Bank of India of Jahangira Branch. The forge L.P.C. has been prepared in collusion with the Branch Manager and C.O. Khagaria and on forge L.P.C. forge account has been opened and K.C.C. loan has been withdrawn by some unknown persons. He further submitted that the others co-accused have already been granted bail by a Co-ordinate Bench vide order dated 30.03.2022 passed in Cr. Misc. No. 50829 of 2021. He is languishing in judicial custody since 24.05.2023.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as period of custody, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the
Patna High Court CR. MISC. No.63981 of 2023(2) dt.11-10-2023 3/3 satisfaction of the learned C.J.M., Khagaria in connection with Khagaria P.S. Case No. 857 of 2018.
