JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code.

The accusation is of cutting the tree from the government land when two logs were recovered from the house of the petitioner.

It is submitted by learned counsel for the petitioner that only on suspicion, the accusation has been levelled. Though, the case was registered in the year 2007 when the accusation was found false and petitioner was not sent up for trial but the differing with the final form the cognizance was taken in the year 2010. The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Patna High Court Cr.Misc. No.23654 of 2015 (2) dt.07-07-2015 2/2 Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Ramgarhwa P.S. Case No. 26 of 2007 pending in the court of learned SDJM, Raxaul at Motihari. Accordingly, the application is disposed of.
