ANJANA PRAKASH ORAL JUDGMENT Date: 17-03-2016 The Petitioner seeks revision of the judgment of conviction dated 10.12.2015 passed by the Additional Sessions Judge 1st, Jehanabad in Criminal Appeal No.26 of 2008/ 12 of 2010, by which he has upheld the conviction of the Petitioner under Section 406 I.P.C. and maintained the sentence of six months R.I. and fine of Rs.5000/-, in default of which simple imprisonment for another one and half month, passed by a judgment dated 1.5.2008 by the Judicial Magistrate, 1st class, Jehanabad in Trial No.303 of 2008 arising out of Jehanabad P.S. case No.422 of 2003.
Having gone through the impugned judgment, I am not inclined to interfere with the conviction.
Hence, the revision application is dismissed. However, considering the change circumstances of the
Patna High Court CR. REV. No.159 of 2016 dt.17-03-2016 2/2 case, the sentence is converted to the Petitioner filing bonds as per Section 3 of Probation of Offenders Act for keeping peace and good behaviour for a period of one year.
