Petitioners apprehend arrest in a case registered for the offences punishable under Sections 30(a), 41(i) of the Bihar Prohibition and Excise (Amendment) Act, 2018. As per prosecution case, 891 litres Nepali Sofi liquor has been recovered from Tata Magic vehicle bearing Registration No. BR-50GA 4381.

Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case. Petitioners are neither owner nor driver of the vehicle in question. No incriminating material has been recovered from the conscious

Considering the aforesaid facts and circumstances, let the above named petitioners in the event of their arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge-V-cum-Special Judge, Excise, Court No. 02, Supaul in Karjain P. S. Case No. 146 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
