The petitioners apprehend their arrest in a complaint case punishable for the offence under Section 406 / 420 of the Indian Penal Code.

As per the prosecution case, the petitioners are alleged to have grabbed total Rs. 2,72,500/- (two lacs seventy two

Patna High Court CR. MISC. No.60214 of 2022(2) dt.17-03-2023 2/3 thousand five hundred only) from the complainant in lieu of arranging VISA for two brothers-in-law of complainant to send them abroad, but neither they were sent to abroad nor petitioners returned any money to the complainant.

It is submitted on behalf of petitioners that petitioners have been falsely implicated in this case due to dirty village politics. Neither any chit of paper nor any document has been produced by the complainant in support of his allegation. No detail has been given as to how and in whose presence, the payment was made. In fact, petitioner never received any money from the complainant. Petitioners have got clean antecedent. Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Bagaha, West Champaran in connection with Complaint Case No. C-504 of 2019 / TR No. 2035 of 2020, 1194 of 2022 (Tr. No. 2035 of 2020), subject to condition as laid down under Section 438(2) of the Code of
