The petitioner seeks pre-arrest bail in connection with Bheldi P. S. Case No.150 of 2016 registered under Sections 272 and 273 of the Indian Penal Code and 47, 49 and 53 of the Bihar Excise Act.
Regard being had to the recovery of certain quantity of illicit liquor from a place from where the petitioner managed to escape on seeing the police party, I am not inclined to grant him pre-arrest bail. Accordingly, his application for grant of pre-arrest bail is rejected.
In case the petitioner surrenders and seeks bail, the
Patna High Court Cr.Misc. No.33248 of 2017 (2) dt.20-07-2017 P2/ same shall be considered on its own merit without being prejudiced in any manner by this order.
