2. The petitioners apprehend arrest in connection with Murar P.S.Case No.70 of 2016 registered for an offence under Sections 149, 341, 323, 353, 354, 504 and 506 of the IPC
3. The informant, who happens to be the Block Development Officer has alleged that on 24.10.2016 these petitioners assembled at block office and raised slogan against distribution oil. They uttered words against the informant and also locked the block office.
4. Learned counsel for the petitioners submits that one of the co-accused had filed complaint case against the BDO. The petitioners were sitting at Dharna. The petitioners are Ward Councilers and were protesting in peaceful manner. He further submits that similarly situated co-accused has been allowed anticipatory bail by a coordinate Bench of this Court in Cr.Misc.No.16260 of 2017 dated 01.05.2017.
5. In view of the aforesaid facts prayer is allowed. Let the
Patna High Court Cr.Misc. No.31240 of 2017 (2) dt.17-07-2017 2/2 above named petitioners be released in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Murar P.S.Case No.70 of 2016 on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of ACJM-III, Buxar subject to the conditions as laid under Section 438(2) of the Cr.P.C.
