JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner was caught when he along with others had assembled to make preparation for committing dacoity and on search, one country made loaded katta and one live cartridge were recovered from conscious possession of the petitioner.

Furthermore, it is alleged that one motorcycle was also recovered from the place of occurrence. Petitioner does not have any criminal antecedent and is languishing in jail custody since 19.11.2015.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with

Patna High Court Cr.Misc. No.7373 of 2016 (2) dt.17-02-2016 2/2 two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, (West) Muzaffarpur in connection with Motipur P.S. Case No. 316 of 2015.
