This is a petition for grant of anticipatory bail for offence under Sections 323, 327, 341, 379, 420, 467, 468, 471 and 120B of the Indian Penal Code.
The petitioner has sold, through registered sale deed, some land to the informant. Allegation is that the land was not of the petitioner, as such, informant was cheated. Since, the complainant has failed to discharge his primary duty, as required under the provisions of Transfer of Property Act to verify the title of his vendor, let the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each in connection with Madhuban P.S. Case No. 8 of 2017 to the satisfaction of the Additional Chief Judicial Magistrate, IV, East Champaran at Motihari, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
