The petitioner has preferred this application for grant of regular bail in a case registered under sections 30(a) and 41 of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, 105.5 litres of country liquor was recovered from the two motorcycles and the petitioner was taken into custody.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case under a misunderstanding. Neither the seized liquor nor any of the two motorcycles belong to the petitioner who is in custody since 11.9.2021 and has no criminal antecedent.

Having heard learned counsel for the parties and

Patna High Court CR. MISC. No.160 of 2022(2) dt.20-04-2022 2/2 taking into consideration the facts of the case, the petitioner having remained in custody for more than 7 months and not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Govindpur P.S. Case no. 225 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District Judge II-cum-Special Judge, Nawada.
