This is a case registered under Sections 363, 366 (A) and 34 of the Indian Penal Code.

Referring to the order dated 31.10.2018 passed in Cr. Misc No. 59481 of 2018 i.e., the order allowing bail to the co-accused Rahul Bhagat counsel for the petitioner seeks parity in the matter of grant of bail. He submits that the said Rahul Bhagat is similarly situated and the grounds on which this Court has allowed bail application are common to the petitioner. Petitioner is in custody since 16.12.2017.

In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/-

Patna High Court Cr.Misc. No.78804 of 2018(2) dt.02-01-2019 2/2 (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge, Katihar in Hasanganj P.S. Case No. 90 of 2017 subject to the conditions : (i) That one of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he is related with the Petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the Petitioner.

(ii) That the Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
