Mangalam, learned Advocate for the petitioner and Mr. Upendra Pratap Singh, learned counsel for the State, we direct respondent no.5, the licensing authority, to take a final decision in the case of the petitioner preferably within a period of sixty days from the date of receipt/production of a copy of this order.

Patna High Court CWJC No.21221 of 2021 dt.22-02-2022 2/2 An action was taken against the petitioner as a licensee under the Public Distribution System System under Section 28 of the Control Order, 2016. No final determination has been made by the licensing authority despite lapse of 180 days.

We do not appreciate the action of the concerned respondent in keeping the matter in abeyance for such a long time. This is neither for the benefit of the consumers nor for the licensee. Any further delay beyond the stipulated period indicated in the order would lead to an adverse inference against the concerned respondent. The petition stands disposed of with the aforesaid direction.
