JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-03-2016 Heard learned counsels for the petitioners and the State. The petitioners being mother, brother's wife, sisters, brother and brother-in-law (Bahnoi) of the husband of the complainant is apprehending arrest in a complaint case in which process has been directed to be issued after cognizance being taken for the offences punishable under Sections 323,313 and 498A/34 of the Indian Penal Code and sections 3 and 4 of Dowry Prohibition Act.
The basic accusation is of torture for non fulfillment of dowry demands and the pregnancy got terminated due to assault.

No.10605 of 2016 (2) dt.02-03-2016 2/2 It is submitted by the learned counsel for the petitioners that the accusation against the petitioners is omnibus and general and the same has been levelled after fifteen years of marriage. The thrust of accusation is against the husband of the complainant. It is further submitted that the petitioners live separate from the husband of the complainant.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, West, Muzaffarpur in connection with Complaint Case No. 2121 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
