Mr.Md. Anzarul Haque Sahara ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 11-01-2019 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Andhramanth P.S. Case No. 174 of 2018 registered for the offence punishable under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding the accused persons having been intercepted by the Police while coming from Nepal on their motorcycle and upon search 130 bottle of illicit Nepali liquor was recovered.

I have perused the bail petition and I find that it has been stated that the petitioner has been falsely implicated in the present case and the fact is that he is a farmer and he has no

Nonetheless, I find that the petitioner is having a fair antecedent except one case in which he is on bail. The petitioner is stated to be languishing in custody since 03.11.2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions JudgeIInd-cum-Special Judge, Excise Act, Madhubani in connection with Andhramanth P.S. Case No. 174 of 2018.
