2. Petitioner seeks regular bail in a case registered for the offences punishable under Sections 302, 120 ( B ) and 34 of IPC and 27 of Arms Act.
3 . The prosecution case , in brief is that an allegation has been made before the SHO that there was a Puja in the house of the Informant and, on that account, all the family members had assembled in the house and her husband and Vaisur had gone outside for bringing milk. In the meantime, the sound of firing was heard and her Vaisur returned and informed her that the accused persons have killed her husband. It has been stated that there was a criminal case lodged by the Husband of the Informant and they were putting pressure upon the
Patna High Court CR. MISC. No.62319 of 2025(3) dt.03-11-2025 2/2 Informant for withdrawal of the same. When the case was not withdrawn, the present incident has taken place .
4. Learned counsel for the petitioner submitted that petitioner is not named in the F.I.R. The name of the petitioner transpired in restatement of informant on suspicion . Except suspicion , there is nothing on record to show the complicity of this petitioner in the alleged occurrence . Petitioner is in custody since 28.06.2025 . Chargesheet has already been submitted.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts, period of custody and other circumstances of the case , the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate Lakhisarai in connection with Lakhisarai P. S. Case No. 14 of 2018.
