JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323 and 504 of the Indian Penal Code and Section 3 (I) (X) of the SC/ST (Prevention of Atrocities) Act.

The prosecution case is that the daughter of the informant was cutting wood from the orchard of the petitioner when petitioner protested and abused her by calling caste name and also assaulted the daughter of the informant and when protest was made by the informant and his wife, they were also assaulted. It is submitted by learned counsel for the petitioner that admittedly the daughter of the informant was cutting wood from the orchard of the petitioner. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Muffasil P.S. Case No. 284 of 2014 pending in the court of learned CJM, Aurangabad. Accordingly, the application is disposed of.
