Petitioner seeks bail in a case registered under sections 376, 511 of the Indian Penal Code.
It is alleged that on 1.12.2014 at 1.30 A.M. the informant was sleeping in house and mother of victim was also sleeping in other room and in the meantime victim opened the door for bathroom. Petitioner pushed the victim in other room and began to start rape and the victim cried and her mother came and caught the petitioner with help of villagers. It has been submitted on behalf of the petitioner that petitioner is in custody since 1.12.2014 and charge sheet in the case has been submitted. Further it is submitted that prior to the institution of the present case the mother of the petitioner has
Patna High Court Cr.Misc. No.22089 of 2015 (2) dt.16-07-2015 2/2 instituted a case against the mother and father and other family member of the victim. The present case is in retaliation to the other case which is annexure-2 to the present bail application. On behalf of the State it has been submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Shri Vivek Rai, J.M. Ist Class, Saran at Chapra in Bheldi P.S. Case No. 177 of 2014. (Sudhir Singh, J) M.Rahman/- U T
