In this case, the petitioner is apprehending his arrest in connection with POCSO Case No. 27 of 2016 arising out of Gogri (Poura) P.S. Case No. 191 of 2016 (G.R. No. 2401 of 2016) registered for offences under sections 376(F) of the Indian Penal Code and Section 4 of the POCSO Act.

An allegation has been made that on giving allurement of passing the matric examination in 1st Class, the petitioner has established sexual relationship with the victim girl and harassed her.

Case Diary has been called upon in this case wherein the statement of the victim girl under Section 164 of the Cr.P.C.

Patna High Court Cr.Misc. No.18681 of 2017 (4) dt.06-07-2017 shows that the victim girl has denied such an incident and made a statement that under wrong advice, she has filed the case. In that view of the matter, let the petitioner, namely, Amit Kumar, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, 1st Khagaria in connection with POCSO Case No. 27 of 2016 arising out of Gogri (Poura) P.S. Case No. 191 of 2016 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
