In this case, the petitioner is apprehending his arrest in connection with Garuri Chak P.S. Case No. 273 of 2016 registered for offences under sections 406, 420/34 of the Indian Penal Code.

An allegation has been made that the petitioner has taken money and give a commitment for execution of the sale deed but, thereafter, reciled from his statement on the one ground of the other and refused to execute the sale deed. Learned counsel for the petitioner submits that this is completely a false case against the petitioner and actually the coaccused persons, after taking full consideration amount from the

Patna High Court Cr.Misc. No.18898 of 2017 (3) dt.06-07-2017 petitioner, had executed the sale deed in favour of his wife and only due to that reason, the petitioner has been implicated in the present case.

Looking to the entire facts and circumstances of the case, let the petitioner, namely, Brij Nandan Pandit, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Patna City in connection with Gauri Chak P.S. Case No. 273 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
