The petitioner has preferred the instant application for grant of regular bail in a case registered under sections 307, 427, 435, 353 and other sections of the Indian Penal Code, section 27 of the Arms Act, section 3 of the Prevention of Damage to Public Property Act, 1984, section 17 of the Criminal Law Amendment Act and sections 10 and 13 of the UAP Act. As per the prosecution case, during the band call given by the Maoist organization, it is stated that vehicles were set on fire and the roads were blocked. On the police personnel reaching the place of occurrence, it is stated that the extremists started to fire. Name of several accused persons transpired in the names they were calling out to each other.
It is submitted by learned counsel for the petitioner
Patna High Court CR. MISC. No.66207 of 2019(7) dt.08-10-2021 2/2 that the petitioner has been falsely implicated in the case. The allegations are general and omnibus in nature. The petitioner is in custody since 28.2.2018 and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the nature of allegations together with grant of bail to other coaccused and the petitioner having remained in custody for over 3 years 7 months, this Court directs the petitioner to be enlarged on bail in connection with Amas P.S. Case no.88 of 2015 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Sherghati, Gaya.
