The petitioner is languishing in custody since 27.03.2015 in a case registered for the offences punishable under sections 419, 420, 467 and 471 of the Indian Penal Code. It is alleged against the petitioner that on the basis of forged and fabricated sale deed the petitioner got his name mutated in the revenue record.

It is submitted by learned counsel for the petitioner that the thrust of accusation is against the vendor, who executed the sale deed and the investigation has already concluded. Considering the fact that investigation has already concluded, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Gaya in connection with Chandauti P.S. Case No.240 of 2014.

However, the learned court below will be at liberty to cancel the bail bonds of the petitioner, if he defaults for two consecutive occasions or gets involved in some serious nature of offence.
