23-01-2019 Heard Sri Baxi S.R.P.Sinha, learned senior counsel assisted by Sri Satya Veer, learned counsel for the petitioner and Sri Narendra Kumar Singh, learned Addl. Public Prosecutor. This is the 2nd attempt for grant of bail on behalf of the petitioner in Raushanganj (Banke Bazar) P.S. Case No. 31 of 2018 registered for offence under Sections 147, 148, 149, 457, 323, 307, 354, 302 of the Indian Penal Code. Recently, on 25-06-2018, the prayer for bail of the petitioner was rejected, vide Cr. Misc. No. 34059 of 2018, considering the fact that there was specific material against the petitioner. Learned senior counsel for the petitioner tried to persuade the Court that the main accused i.e. Pradeep Prajapat in the present case has already been granted bail by a coordinate
Patna High Court Cr.Misc. No.79150 of 2018(3) dt.23-01-2019 2/2 Bench of this Court. He submits that petitioner's case is on better footing than the case of Pradeep Prajapat, the main accused, and as such, the petitioner deserves to be released on bail.
However, considering the fact that on merit, the prayer for bail of petitioner was rejected as well as the fact regarding accusation against the petitioner, even though, other accused has been granted bail by a coordinate Bench, I am of the opinion that there is no need to pass favourable order. The prayer for bail again stands dismissed.
